Right of withdrawal
Below you will find, for each type of contract offered on this website, whether a statutory right of withdrawal (Rücktrittsrecht under the Austrian Distance and Off-Premises Contracts Act, FAGG) exists.
No right of withdrawal for food and drinks
For the ordering of prepared food and drinks there is no statutory right of withdrawal. Legal basis:
- § 18 para 1 no 4 FAGG — goods that spoil quickly or whose use-by date would quickly be exceeded; and
- § 18 para 1 no 10 FAGG — among other things the supply of food and drinks, and services connected with leisure activities, where in each case a specific time or period for performance is contractually provided for.
You are informed of this before submitting the order and confirm it by placing the order. Cancellation before we start preparing your order, and goodwill arrangements, are covered by our terms.
No right of withdrawal for table reservations
A free table reservation creates no payment obligation, so the FAGG does not apply to it in the first place. Independently of that, a service connected with leisure activities for a specific date and time would be excluded from the right of withdrawal under § 18 para 1 no 10 FAGG. Summary
None of the contracts concluded via this website carries a statutory right of withdrawal, for the reasons set out above. This does not affect your statutory warranty rights.
