Terms
These terms govern all contracts concluded via this website with Bella Vista Restaurant e.U., Mariahilfer Straße 120, 1070 Wien, Austria. Contact: hallo@bella-vista.at · +43 1 234 56 78.
1. Scope and contracting party
These terms apply to contracts with consumers (§ 1 para 1 no 2 KSchG) concerning:
- ordering food and drinks for pickup or delivery,
- reserving a table,
Your contracting party is exclusively the business named above. The operator of the software platform is not a party to the order or reservation contracts concluded here and does not act as seller, supplier or payment service provider.
Contracts are concluded in German. The German version of these terms prevails; the English text is a convenience translation.
2. How a contract is formed
The presentation of dishes and drinks on this website is not a binding offer but an invitation to place an order.
Clicking “Order with obligation to pay” submits a binding offer. Before submitting, the order lines, quantities and the total price including VAT (plus any delivery fee) are shown in summary.
You can correct input errors at any time before submitting: quantities can be changed and lines removed in the cart, and the summary shown above the order button lets you check every entry. We do not store the contract text separately for retrieval on this website after the contract is concluded; you receive the order details by email and can keep them for your own records.
The contract comes into existence once we accept the order by confirmation (by email or in the app). An automatic acknowledgement of receipt is not yet an acceptance unless it expressly states so.
For table reservations the contract comes into existence with our reservation confirmation.
3. Confirmations are not receipts
Confirmations, order emails and any printouts are not cash-register receipts and not invoices. Tax receipts and fiscal recording are issued exclusively by the venue’s own cash register (Registrierkasse) on site.
4. Prices and VAT
All prices are final prices in euro and include statutory VAT. For deliveries an additional delivery fee may apply; it is shown separately and clearly before the order is completed.
5. Payment
The payment methods available for your order are shown during checkout (card payment via Stripe, or payment on pickup/delivery). With online payment the amount falls due upon conclusion of the contract in accordance with the payment service provider’s terms.
6. Pickup and delivery
Pickup: you collect the order at the agreed time at Mariahilfer Straße 120, 1070 Wien.
Delivery: we deliver within the delivery area shown during checkout. Stated delivery times are estimates and not fixed dates unless a binding delivery time has been expressly agreed; deviations can arise for objective reasons — kitchen workload, weather and traffic — and we will inform you as early as possible. Please make sure the delivery can be accepted; if delivery of perishable food fails for reasons attributable to you, there is no claim to redelivery or refund.
7. Cancellation
Food and drink orders: there is no statutory right of withdrawal for prepared food and drinks (Right of withdrawal). You can cancel only as long as we have not yet started preparing your order; a goodwill cancellation is at our discretion. Please contact us immediately: hallo@bella-vista.at · +43 1 234 56 78.
Reservations: please cancel as early as possible using the link in your reservation confirmation or by phone, so we can give the table to other guests.
8. Warranty and liability
The statutory warranty rules under the ABGB, the Consumer Warranty Act (VGG) and the KSchG apply. Warranty rights of consumers are neither excluded nor shortened.
We are liable under the statutory provisions. Any limitation of liability applies only to the extent permitted by law towards consumers; liability for personal injury and for intent and gross negligence remains unaffected.

9. Allergens
Allergenic substances are labelled with the codes A–R (EU Food Information Regulation / Codex recommendation) on the menu. If you have questions about ingredients, please ask us before ordering: hallo@bella-vista.at · +43 1 234 56 78.
10. Dispute resolution
We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board. Please contact us directly first — most issues are settled quickly. The EU online dispute resolution platform was discontinued on 20 July 2025.
11. Applicable law
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the state in which the consumer is habitually resident remain unaffected. Should any provision be invalid, the remaining provisions stay in force.
